Publisher
Mozart Benchmark is published in a personal, non-professional capacity by a private individual established in the Netherlands. The site is offered on a non-profit basis: it carries no advertising, sells nothing and offers no subscription. In the absence of economic activity, it does not constitute an information society service within the meaning of article 3:15d of the Dutch Civil Code (Burgerlijk Wetboek), and the publisher exercises the right not to disclose their identity publicly.

Intellectual property
The code, the text, the interface and the visual identity of the site are the work of its publisher.
- The music clips (official 30 second previews) and the album covers remain the property of their rights holders. They are never hosted by the site: they are fetched at playback time from Deezer’s public interfaces.
- Lyrics are only shown as short extracts, within the limits of the right of quotation.
- The synthesised sounds (chords, rhythms, ambience) are generated by the site itself, in your browser.
- The instrument samples come from freely reusable sound banks.
Reporting content
Any rights holder, or any third party, may report content they consider problematic to the contact address above, giving the location of the content and the reason for the report. After checking, the content in question is taken down without delay.
Games with friends
Games with friends are private: they can only be reached by the people the code was given to, they are listed nowhere and they are not indexed. Nicknames are chosen freely and are not moderated in advance, precisely because they are neither published, nor indexed, nor visible outside the room; the nicknames on the public leaderboards, the daily challenge and the games alike, follow the rule set out in the next section. The host can remove a player, and the whole game closes as soon as the host leaves, or after ten minutes without activity, then disappears no later than thirty minutes after that. No written messages can be exchanged in one.
Public leaderboards
The site publishes two kinds of leaderboard: the daily challenge board, and the survival game boards. All are public: the nicknames on them are shown on the site home page, on the challenge page and on the page of the game concerned. Unlike those of games with friends, they are filtered automatically before publication, and that filter is replayed on every display. A nickname that has not been positively validated is not shown: it is replaced by a neutral label, and the score stays on the board. Any nickname can also be removed on request, at the contact address above; a report link appears under every board. The challenge board resets every day and the nicknames disappear with it. The game boards do not reset: they keep the fifty best runs, and a line disappears from them as soon as it drops out of those fifty. None of these boards creates an address of its own for a player, and none is indexed name by name.
Liability
The site is provided free of charge, as is, with no guarantee of availability or accuracy. It depends on third party services (supply of music clips, hosting) over which the publisher has no control. The scores obtained in the mini-games are entertainment: they have no value as an official test or as a certified assessment of musical ability.
Applicable law
The site and this notice are governed by Dutch law. Consumers residing in the European Union keep the protection of the mandatory provisions of the law of their country of habitual residence.
